These Terms of Service (“Terms”) govern your access to and use of the 4TheDeal website and services.

4TheDeal is operated by Nayeet Innovations F.Z.E., a company registered in the Ajman Free Zone, United Arab Emirates (UAE).

In these Terms, “4TheDeal,” “we,” “us,” and “our” refer to Nayeet Innovations F.Z.E.

By accessing or using 4TheDeal, you agree to these Terms. If you do not agree with them, please do not use the website or services.

1. About 4TheDeal

4TheDeal is a platform that helps shoppers discover offers, promotions, clearance items, limited-time opportunities, special prices, bundles, products, services and other opportunities provided by businesses.

Shoppers may also submit requests describing products or services they are looking for. Where possible, 4TheDeal may identify suitable businesses that can potentially respond with an offer.

4TheDeal provides the platform and facilitates these interactions but does not generally sell the products or services offered by businesses.

2. Using 4TheDeal

You agree to use 4TheDeal only for lawful purposes and in accordance with these Terms.

You must provide accurate information when submitting a request, creating an account, submitting a deal or otherwise using the platform.

You must not:

- Provide false, misleading or fraudulent information

- Impersonate another person or business

- Use the platform for unlawful purposes

- Attempt to interfere with or compromise the security of the website

- Abuse, manipulate or exploit the platform

- Submit content that infringes another person's rights

- Use the platform to distribute spam or harmful material

- Attempt to gain unauthorized access to accounts, systems or information

3. For Shoppers

Shoppers may browse available deals and submit a Request a Deal.

A Request a Deal is a request for an opportunity, product or service. Submitting a request does not guarantee that 4TheDeal will find a suitable offer or that any business will respond.

Where a suitable business is identified, information relevant to the request may be shared with that business so it can determine whether it can make an offer.

Any offer received is subject to the business's own availability, pricing, terms and conditions.

Shoppers are free to decide whether or not to accept an offer.

4. For Businesses

Businesses may submit offers, promotions, clearance items, limited-time opportunities, special prices, bundles, products, services and other commercial opportunities.

Businesses may also have the opportunity to respond to suitable customer requests where the platform makes such requests available to them.

By submitting a deal, a business confirms that:

- It is legally registered and permitted to operate

- It holds any licences or approvals required for its activities

- The information submitted is accurate and not misleading

- It has the right to advertise and provide the relevant product or service

- The offer complies with applicable laws and regulations

- It will honour the terms of an offer it publishes or accepts

Businesses are responsible for their products, services, pricing, availability, quality, fulfilment, customer service, refunds and other obligations arising from their transactions with shoppers.

5. Deal Submissions and Review

4TheDeal may review business submissions before publication.

We may approve, reject, edit, suspend or remove a submission where we consider it necessary to maintain the quality, accuracy, safety or integrity of the platform.

This may include submissions that are:

- Misleading or inaccurate

- Expired or unavailable

- Potentially fraudulent

- Unlawful or inappropriate

- Inconsistent with our policies

- Likely to harm users or the reputation of the platform

Submitting or publishing a deal does not constitute an endorsement, certification or guarantee by 4TheDeal.

6. Offers and Transactions

Unless expressly stated otherwise, 4TheDeal is not the seller, supplier or provider of products and services advertised by businesses.

The business providing the product or service is responsible for the transaction.

Prices, availability, product descriptions, warranties, delivery, fulfilment, cancellations and refunds are generally matters between the shopper and the relevant business.

Shoppers should review the details and terms of an offer before entering into a transaction.

7. Accuracy and Availability of Deals

Businesses are responsible for keeping their offers accurate and up to date.

An offer may be subject to availability, expiry dates, quantity limits, eligibility requirements, appointment requirements or other conditions disclosed by the business.

4TheDeal does not guarantee that a particular deal will remain available or that information supplied by a business will always be accurate or current.

8. Request a Deal

When submitting a Request a Deal, shoppers should provide accurate and useful information about what they are looking for.

A request may include information such as:

- Product or service

- Category

- Location

- Budget

- Timing

- Preferences

- Additional requirements

4TheDeal does not guarantee that a suitable business will be found or that a request will receive an offer.

Businesses that receive or are presented with suitable requests may decide whether or not to respond.

9. Communications

By providing contact information, including an email address or WhatsApp number, you agree that 4TheDeal may use that information to communicate with you about your requests, submissions, offers, account or use of the platform.

Where you select a preferred method for receiving offers, we may use that method to facilitate relevant communications.

Any marketing communications will be handled in accordance with applicable law and any required consent.

10. Fees and Payments

4TheDeal may charge businesses fees for listing, promotion, featured placement, or access to certain shopper leads or Requests a Deal, as described on our pricing page or in a separate agreement with the business.

Fees are payable in advance unless otherwise agreed. Fees are generally non-refundable except where required by applicable law or expressly stated at the time of purchase.

4TheDeal does not charge shoppers to browse deals or submit a Request a Deal.

We may change our fees from time to time. Changes will not affect fees already paid for a current listing, promotion or other paid service period.

Late or failed payment may result in suspension or removal of a business's listings, promotional placement or access to paid features until the outstanding payment is resolved.

11. Business Verification

4TheDeal may request information from businesses to verify their identity, registration, licensing or the authenticity of their offers.

Verification does not mean that 4TheDeal guarantees the quality, legality, availability or suitability of a business, product or service.

Businesses remain responsible for complying with all applicable legal and regulatory requirements.

12. User Content

Users and businesses may submit text, images, descriptions, logos, contact information and other content to 4TheDeal.

You remain responsible for the content you submit and confirm that you have the necessary rights to provide it.

By submitting content, you grant 4TheDeal a non-exclusive permission to use, reproduce, display, format and distribute that content as reasonably necessary to operate, promote and provide the platform.

We may remove content that violates these Terms or that we reasonably believe is inappropriate, misleading, unlawful or harmful.

13. Intellectual Property

The 4TheDeal name, logo, branding, website design, original text, graphics and other materials provided by 4TheDeal are owned by or licensed to Nayeet Innovations F.Z.E. unless otherwise stated.

You may not reproduce, modify, distribute, sell or commercially exploit our intellectual property without permission.

Nothing in these Terms transfers ownership of 4TheDeal intellectual property to you.

14. Third-Party Websites and Services

4TheDeal may contain links to third-party websites, services or businesses.

We do not control those third parties and are not responsible for their products, services, content, availability, security, policies or practices.

Your use of third-party services may be subject to their own terms and privacy policies.

15. Disclaimer

4TheDeal provides a platform for discovering and requesting deals and opportunities.

To the extent permitted by applicable law, we do not guarantee:

- That a particular deal will be available

- That a Request a Deal will receive a response

- That a suitable business will be found

- That an advertised price will remain unchanged

- That a product or service will meet your expectations

- That a business will fulfil an offer

- That all information submitted by businesses will always be accurate or current

Users should make their own decisions and, where appropriate, independently verify an offer or business before entering into a transaction.

16. Limitation of Liability

To the extent permitted by applicable law, 4TheDeal and Nayeet Innovations F.Z.E. will not be responsible for losses, damages, disputes or claims arising from transactions or interactions between shoppers and businesses, including the products, services, representations, availability or fulfilment of a business.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

17. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless 4TheDeal and Nayeet Innovations F.Z.E. from claims, losses, liabilities, damages and reasonable expenses arising from your unlawful use of the platform, violation of these Terms, or content you submit that infringes the rights of another person.

18. Suspension or Termination

We may suspend, restrict or terminate your access to 4TheDeal if we reasonably believe that you have:

- Violated these Terms

- Provided fraudulent or misleading information

- Misused the platform

- Engaged in unlawful activity

- Attempted to compromise the platform or its users

- Created a significant risk to 4TheDeal or others

We may also remove or restrict access to submitted content where appropriate.

You may stop using 4TheDeal at any time.

19. Changes to These Terms

We may update these Terms from time to time.

When changes are made, we will update the “Last Updated” date at the top of this page.

Your continued use of 4TheDeal after updated Terms are posted may constitute acceptance of the revised Terms to the extent permitted by applicable law.

20. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, subject to any mandatory consumer protection or other applicable federal laws.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Ajman, United Arab Emirates.
